For most claims, a claimant may file a claim with the Trust only after the claim has been fully and finally resolved in the tort system. Under some circumstances, which are set forth in the TDP, a claimant may file a claim with the Trust without first resolving his or her claim in the tort system. Claimants are encouraged to review the TDP carefully to determine the proper procedure for his or her claim. A complete copy of the TDP is available for download on the Resources page of this website. The Kaiser Gypsum Personal Injury Asbestos Trust Claim Form (pdf is fillable) is available on the Resources page as well.
